Top NHS Raiders – Irwin Mitchell, Leigh Day and Pannone
It’s big, dumb and it’s got deep pockets…
Following our story last week that considered the fees being generated by firms acting both for and against the public sector, further news follows this week showing who has been making what in clinical negligence claims against the NHS. The top three were Irwin Mitchell, which accrued £10.7m in claimant costs, Leigh Day £4.9m and Pannone £4.8m (click here to see which other firms make the Times top ten table). The fees are causing consternation in some circles.
However, in the firms’ defence, Des Hudson, chief executive of the Law Society, said: “No fees are payable if a claim against the NHS is unsuccessful. Fees are recovered only when the NHS is at fault and if the court is satisfied that the fees claimed are appropriate. There is ample opportunity for any party, including the NHS, to challenge the fees if they choose to do so.”

I don’t think anyone is complaining about the fact that compensation must be paid to those who suffer injury but it is the size of the fees that is galling.
